Fair trading Act
The Fair Trading Act covers the advertising and selling of goods and services by people in trade. It does NOT cover private sales.
The Act Prohibits:
Misleading and deceptive conduct
You have been misled if the information you receive about goods or services gives you a false impression.
False representations
You have had a false
representation made to you when the information you receive about goods (or services) is not true.
Unfair practices
An unfair practice is a selling method which is misleading or unfair. For example,
- Offering prizes and gifts without intending to supply them as offered.
- Bait advertising-advertising goods and services at a specified price without intending to supply them at that price, in reasonable quantities and for a
reasonable time.
Note: False representation is characterised by the information being untrue rather than just misleading. Misleading information is not just untrue it just gives a false impression.
